- Nóta Horizontale Vereinbarungen können den Wettbewerb einschränken, insbesondere wenn Preise festgesetzt oder Märkte aufgeteilt werden oder wenn die Marktmacht, die sich aus der horizontalen Zusammenarbeit ergibt, negative Auswirkungen bei den Preisen, der Produktion, der Innovation oder der Vielfalt und Qualität der Produkte verursacht. Die horizontale Zusammenarbeit kann aber auch einen Weg darstellen, um Risiken zu teilen, Kosten einzusparen, Know-how zusammenzulegen und die Innovation zu beschleunigen. Insbesondere für kleine und mittlere Unternehmen kann die Zusammenarbeit ein wichtiges Mittel der Anpassung an die sich verändernden Marktbedingungen darstellen.

- Nóta Horizontal agreements may restrict competition in particular where they involve price fixing or market sharing, or where the market power resulting from the horizontal co-operation causes negative market effects with respect to prices, output, innovation or the variety and quality of products. On the other hand, horizontal co-operation can be a means to share risk, save costs, pool know-how and launch innovation faster. In particular for small and medium-sized enterprises co-operation can be important means to adapt to the changing market place.

Par ailleurs, une coopération horizontale peut être un moyen de partager les risques, de réaliser des économies de coûts, de mettre en commun un savoir-faire et de lancer des innovations sur le marché plus rapidement. Pour les petites et moyennes entreprises, en particulier, la coopération est un important moyen d'adaptation à l'évolution des marchés.
